TERMS AND CONDITIONS FOR PARTICIPATION
IN THE PROGRAM OF RECOMMENDATIONS “GIVE DISCOUNTS”
(hereinafter the “Terms” and the “Program” respectively).

Effective since 18 September 2020

General Provisions

1.1. The Program shall be implemented by Philip Morris Kazakhstan LLP (hereinafter “PMK”) in the Republic of Kazakhstan through the website www.iqos.com (hereinafter the “Website”), through personal sales assistants and PMK’s domestic outlets (hereinafter “IQOS Stores”).

1.2. Any person who has attained 21 years of age and is older and got registered in the in the IQOS User Database of PMK (hereinafter the “PMK Database”) may become a participant of the Program (hereinafter the “User”).

1.3. The Program is based on communications between the User and his/her Friend –smoker only who has attained 21 years of age or is older, who is not registered in the PMK Database, does not use IQOS system and has not bought any IQOS systems including IQOS 2.4Р Kit and/or IQOS 3 DUO Kit through the Website, personal sales assistants and IQOS Stores (hereinafter the “Friend”).

User Recommendation Code Receipt Terms and Conditions

2.1. The User shall get an individual reusable recommendation code (hereinafter the “Code”) automatically within 2 (two) days following the purchase of his/her first IQOS system in an SMS-message on his/her mobile phone and/or e-mail address specified for registration with PMK Database (sample recommendation code: GC-**********).

2.2. Should the User fail to receive the code automatically for any reason whatsoever, he/she shall address the Customer Care by phone 8 8000 80 12 21 (toll free throughout Kazakhstan), via online chat on the Website, Telegram messenger, or SMS with the word IQOS to 2121.

2.3. The User can get his/her Code using the communications channels described in paragraph 2.2 above.

Code Transfer and Use

3.1. To participate in this program the User shall address his/her Friend with the following question: “Would you like to know of an alternative to smoking?” In case the response is positive, the User shall offer his/her Friend to get registered in the PMK’s Database using the code. The Friend shall be registered on the Website at https://kz.iqos.com/ru/registration/.

3.2. The User shall be sent an SMS notification of successful Friend’s registration and after that the User will be able to advise his/her Friend of IQOS tobacco heating systems as an alternative to smoking cigarettes, effective Give Discounts Program and the terms and conditions thereof.

3.3. It is PROHIBITED to advise the Friend of IQOS tobacco heating system as an alternative to smoking cigarettes, this program and the terms and conditions thereof before his/her registration in the PMK’s Database, and/or post the codes within public access including the Internet (including, but not limited to social media, forums, groups, and blogs). In case of failure to meet this requirement, the Code and vouchers received as a result of the application thereof may be blocked.

Use of the Code by the Friend

4.1. To use the Code, the Friend must be registered with PMK Database and

  1. a) buy the products specified in paragraph 4.2 below, and (or)
  2. b) test drive an IQOS device during 14 days at an IQOS Store[1] (hereinafter the “Test Drive”).

4.2. Upon the occurrence of the events specified in Clause 4.1.a) hereof the Code gives the Friend a single-use discount of KZT 3,000 (three thousand), unless otherwise stated by PMK, for the whole shopping cart on the Website or all products in one receipt at an IQOS Store or a personal sales assistant provided that one of the products in the cart/receipt is IQOS 2.4Р Kit or IQOS 3 DUO Kit.

PLEASE NOTE! KZT 3,000 (three thousand) discount of the Friend is not cumulative with other discounts and special offers on the Website and (or) in IQOS Stores.

4.3. Code Application by the Friend

  1. a) Purchase (under Clause 4.1.a) hereof): When ordering on the Website, the Friend should enter the Code of the User in the Do-you-have-a-code? box. When purchasing in an IQOS Store or from a personal sales assistant, the Friend should report the code to the relevant sales assistant or personal sales assistant.
  2. b) Test Drive (under Clause 4.1.b) hereof): When formalizing his/her Test Drive at an IQOS Store or a personal sales assistant the Fried should report the code to the relevant sales assistant or personal sales assistant.

4.4. One Friend can use the Code of one and the same User to buy IQOS 2.4Р Kit and/or IQOS 3 DUO Kit and have a Test Drive only once. The Code shall be deemed applied successfully upon Test Drive formalization at an IQOS Store and(or) payment by the Friend for the purchase made using the Code in an IQOS Store or upon delivery of the Website order made using the Code to the Friend.

Receipt of Discount Voucher and Codes by the User

5.1. Subject to the rules set forth in sections 1-4 above and successful use of the Code by the Friend (Clause 4.3.a) hereof), the User shall get 1 (one) discount voucher for KZT 3,000 (three thousand)(hereinafter the “voucher”), provided that the value of the purchase is KZT 10,000 (ten thousand) or more, for any products available in IQOS Stores, at personal sales assistant or on the Website, unless otherwise stated by PMK. The voucher shall be sent to the User within 2 (two) business days following receipt by the Friend of his/her first IQOS Kit.

5.2. The User shall get the voucher automatically by way of a single-use unique code (sample voucher: VC - **********) in SMS-message on his/her mobile number and/or email address specified for registration with PMK Database.

5.3. Subject to the rules set forth in sections 1-4 above, for each 3rd (third) successful application of the Code by the Friends (Clause 4.3.a) hereof), the User shall get 1 (one) additional voucher for 30% discount (hereinafter the “bonus voucher”) for any IQOS accessories available in IQOS Stores or on the Website, unless otherwise stated by PMK. The voucher shall be sent to the User within 2 (two) business days from receipt by each third Friend of his/her first IQOS Kit.

5.4. The User shall get the bonus voucher automatically by way of a single-use unique code (sample voucher: BONUS - **********) in SMS-message on his/her mobile number and/or email address specified for registration with PMK Database.

5.5. However, neither the voucher nor the bonus voucher is or may be used as a payment instrument on the Website, to a personal sales assistant or in IQOS Stores, any type of currency or security. The voucher and the bonus voucher shall give discounts only to the User as set forth in paragraphs 5.1 and 5.3 subject to any other terms and conditions of the Website applicable to ordering goods.

5.6. Subject to the rules set out in sections 1-4 above and successful application of the Code by the Friend (Clause 4.3.b) hereof) the User shall get 1 (one) promo code for KZT 2,000 (two thousand) for passenger and luggage transportation services by taxi ordered via Yandex.Taxi[2] (hereinafter the “Promo Code”).  The Promo Code shall be sent to the User within 2 (two) business days following the day when the Friend formalizes his/her Test Drive at an IQOS Store.

Use of the Voucher by the User

6.1. The User can use his/her voucher (bonus voucher) when ordering products on the Website through entering the single-use unique code in the Do-you-have-a-code? box or when paying for the products to personal sales assistant by disclosing the same to such personal sales assistant or in IQOS stores through disclosing the same to a sales assistant. One voucher (bonus voucher) can be applied to one order on the Website or one receipt in IQOS Stores or personal sales assistant only. Website orders made using the voucher (bonus voucher) shall be delivered free of charge in accordance with the Website delivery terms and conditions.

6.2. The User may use one voucher (bonus voucher) only for one order on the Website or one purchase in IQOS Stores or from a personal sales assistant. Should any order be cancelled or products bought with the voucher (bonus voucher) returned, the voucher (bonus voucher) shall not be recovered. The voucher (bonus voucher) may not be used to buy a gift certificate.

6.3. Should any Website order using a voucher (bonus voucher) be cancelled for any reasons beyond the User’s control, such used voucher (bonus voucher) shall be deemed invalid as it is single-use. In this case the User may call the Customer Care by phone 8 8000 80 12 21 to clarify the procedure of a new voucher (bonus voucher) obtaining or wait for a call from the Customer Care and a replacement voucher (bonus voucher) receipt within 2 business days following the failure to use the voucher (bonus voucher).

PLEASE NOTE! Vouchers shall not be cumulative with one another or other discounts and special offers on the Website and (or) in IQOS Stores, except for discounts under the Temporary Price Reduction promotion.

Use of Promo Codes by the User

7.1. The User may only use the Promo Code through Yandex.Taxi application.

In order to do so the User shall:

-              download Yandex.Taxi (0+) application from AppStore or Google Play;

-              have his/her payment card registered in the application;

-              enter the Promo Code in Promo Code Box;

-              select payment card option when ordering taxi.

7.2. Any questions and (or) claims arising in connection with the Promo Code use in Yandex.Taxi application shall be between the User and Yandex. PMK shall not be liable for any Yandex’s obligations whatsoever in connection with the Promo Code use by the User.

7.3. In order to get a discount under Clause 5.6 hereof the User shall apply his/her Promo Code in Yandex.Taxi in any Kazakhstan cities where Yandex.Taxi operates.

7.4. Should the User fail to activate his/her Promo Code, he/she shall contact the Customer Care at support@taxi.yandex.kz. Please see the Rules of Promo Codes use at taxi.yandex.kz/promocode.

Final Provisions

8.1. In case of failure to meet the Program Terms, the User can be excluded from the Program and his/her code and vouchers (bonus vouchers) terminated without any additional notification.

8.2. The Program Terms may be replaced with and (or) amended through publication of the new Terms on the Website and/or in IQOS Stores at the sole discretion of PMK. New Terms shall inure upon such publication. By continuing use of the codes and (or) vouchers (bonus vouchers) after such changes and (or) amendments to the Program Terms, the User confirms his/her consent to the new Program Terms.

8.3. PMK shall reserve the right to terminate the Program without any additional notifications and explanations.

8.4. The User agrees to the Program Terms upon transfer of the code to the Friend in accordance with section 3 of these Terms.

8.5. The Program will be conducted from 18 September 2020 to 31 December 2020, whereupon the Program may be extended at the sole discretion of PMK. Codes and vouchers (bonus vouchers) may be used during the Program validity period only. Upon completion of the Program all vouchers (bonus vouchers) and Codes will be canceled automatically without further notice.

 

[1] The terms and conditions of IQOS Test Drive shall be governed by Public Agreement of Retail Purchase and Sale in Philip Morris Kazakhstan LLP’s domestic outlets available for review at IQOS Stores.

[2] Yandex.Taxi application owned by Yandex.Taxi B.V. or any affiliates thereof (hereinafter “Yandex”), Yandex.Taxi mobile application are available for downloading from AppStore and Google Play.
